Participation and accounts

You must be at least 18, give accurate information and protect your account. You must own the copyright in the photo and message or have enough authority from the rights owner to submit them and grant this licence. Appearing in a photo, receiving a copy or finding it online does not itself give you copyright. You must have permission from every identifiable adult who is a deliberate subject. An identifiable under-18 must not be an intentional subject; incidental background people are assessed proportionately. You must have written the message or be authorised to submit it, and it must not infringe rights, unlawfully disclose another person’s information, or contain prohibited defamatory or criminal allegations.

Ownership, content licence, moderation and public display

You keep copyright ownership, subject to third-party rights. You grant 100M a non-exclusive, worldwide, royalty-free licence, limited to operating, maintaining, displaying and promoting the project, to host, store, reproduce, publicly display and communicate the photo and message; publish them in the Gallery and related pages; create thumbnails, media layers and responsive versions; resize, crop, compress, convert and make technically necessary layout or formatting adaptations; moderate them; keep operational and backup copies; show them in screenshots, demonstrations and wider-mosaic/project representations; and translate messages on request. 100M may sublicense only as reasonably necessary to service providers, processors or operational partners providing the service. The licence does not transfer ownership, permit general sale or separate commercial licensing to unrelated third parties, or require a blanket waiver of moral rights.

Payment and refunds

Approved submissions cost $1 USD. Payment is processed by Stripe Checkout only after review and does not guarantee continued publication. If 100M itself permanently removes an approved paid submission for reasons not caused by customer wrongdoing, a refund will normally follow automatically. Exact treatment and possible exceptions for fraud, abuse, unlawful content, copyright or privacy/rights infringement, misrepresentation or another material breach remain subject to the applicable refund/cancellation rules. A completed refund withdraws the related public entry.

You have 14 calendar days from successful payment to change your mind, remove the submission and receive a full refund. After that, removal remains available but is not normally refundable for an ordinary change of mind. Full refunds have no cancellation fee and no Stripe-fee deduction. Approved refunds are returned through the original payment method; Stripe and the payment provider control when funds appear.

A full refund applies to a change-of-mind cancellation within 14 calendar days of successful payment, a duplicate or erroneous payment, non-fulfilment, or permanent removal by 100M without customer fault. Ordinary removal after 14 days is normally non-refundable. Breach cases are assessed under applicable law and the service provided; privacy or legal removal is a separate decision. Approved refunds are initiated promptly for the amount and currency charged through the original payment method; Stripe and the payment provider control when funds appear.

Public sharing, project promotion and misuse

Public submissions may be viewed, favourited and shared. The ordinary licence covers screenshots, demonstrations, press or promotional images of the wider Gallery or mosaic where a submission appears incidentally. Prominent use of one person as the main face of an advertisement, endorsement, individual paid-social campaign or standalone branded image requires separate explicit permission. Once content is public, independent screenshots, downloads, search caches, archives or lawful reposts may remain outside 100M’s control. Do not misuse the service, manipulate statistics, infringe rights or interfere with security.

Permanence, removal, availability and contact

100M is designed as a permanent public project. Approved paid submissions are intended to remain publicly available indefinitely, but publication remains subject to these Terms, applicable law, valid privacy or legal rights, moderation, safety, technical necessity and removal/refund rules. The content licence lasts while the submission remains part of 100M and only as long afterwards as reasonably necessary to complete removal, meet legal duties, rotate backups, perform technical housekeeping, preserve audit evidence or handle a dispute. After valid permanent removal, 100M will stop new public or promotional use, suppress the public surfaces and media it controls, prevent ordinary republishing, and let backup copies expire under its retention schedule; legally justified accounting, security, audit or dispute records may remain. 100M cannot erase independent copies outside its control. We may change the service or these Terms, and availability is not guaranteed. See the Privacy Policy and Cookie Policy, or contact us.

Our standard of care and liability

100M will provide the service with reasonable care and skill. For consumers, 100M is responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. Nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, statutory consumer rights, or any liability that cannot lawfully be excluded or restricted. We are not responsible to the extent loss is caused by your false information, unlawful or prohibited content, false rights warranties, misuse of credentials, deliberate circumvention of controls, or failure to follow reasonable security instructions; this does not excuse any failure by 100M. For a person acting wholly or mainly for business purposes, so far as law permits, 100M excludes loss of profit, revenue, business, anticipated savings, business opportunity and indirect or consequential commercial loss.

Availability, maintenance and continuity

We aim to keep 100M available and preserve eligible published submissions, but do not guarantee 100% uptime, uninterrupted service, zero data loss, or uninterrupted hosting, payments, moderation, email or internet access. Reasonable planned maintenance may cover updates, security, infrastructure or provider migration, databases, repairs, accessibility and performance; prolonged planned outages may be communicated where reasonably practical. We may temporarily restrict or suspend only what is reasonably necessary for cybersecurity, fraud, abuse, legal or regulatory duties, serious provider failure, data-integrity threats, serious technical faults, safety or protection of users or the service. Third-party failures outside our reasonable control may affect availability, but do not automatically remove rights you have against 100M. Delay or failure caused by natural disaster, widespread infrastructure or telecommunications failure, war or civil emergency, government or legal restriction, or a critical provider outage is excused only to the extent caused by that event and does not erase accrued statutory rights or a remedy that is due. We take reasonable preservation measures and use backups where configured, and will try to restore or recover where reasonably possible; no absolute technical guarantee is given. 100M is intended as a long-term permanent public project. If continued operation becomes genuinely impossible, unlawful, unsafe or commercially or technically unsustainable, some or all service may be suspended or discontinued. Where reasonably practical, we will give notice, protect project records, consider migration or a successor, and honour applicable refund, remedy, privacy and legal obligations.

Content, moderation, security and external services

Contributors remain responsible for their content and warranties. Publication or moderation is not endorsement, factual or legal verification, authentication, or proof of copyright, identity, permission or age. Automated and human moderation, including Azure AI Content Safety, aims to reduce risk but cannot guarantee detection of every infringement, unauthorised portrait, false or offensive statement, impersonation, unlawful item, privacy issue or other rights violation, and may produce false positives or negatives. Credible reports will still be handled through the applicable complaint, review, restriction and removal process. 100M takes reasonable technical and organisational measures to protect the service and information, without promising invulnerability or universal freedom from malware. You must take reasonable care of passwords, activation/reset links and guest entitlement links or tokens, but are not responsible for compromise caused by 100M’s own security failure. Independently operated websites control their own content, availability, security, privacy and processing after you follow an external link; a link does not imply endorsement. This does not exclude responsibility for services or publication still controlled by 100M.

No investment promise; service, Terms and succession changes

Participation does not guarantee publicity, followers, media coverage, commercial leads, revenue, fame, recognition, resale value, investment returns or financial appreciation. A submission number, wall position or permanent identifier is part of the service, not a security, investment product, owned digital or real property, transferable financial asset or promise of monetary value. It is not transferable unless 100M later expressly introduces a lawful mechanism. We may change visual design, navigation, hosting, technology, the Gallery, accessibility, performance, moderation tools or providers, but must not materially remove the core purchased service without an appropriate remedy. Terms may be updated for legal, security, operational or service reasons, generally prospectively; material changes will be brought to customers’ attention where appropriate. Completed transactions remain linked to the accepted Terms version unless law requires otherwise or a later change is separately accepted. A lawful future transfer of the service or business to a successor is subject to privacy duties, applicable law, customer rights and appropriate continuation or assumption of obligations; it is not a sale of individual photographs as standalone assets. Moderation, restriction or removal decisions remain subject to these Terms, the Content Rules, complaint or review routes and law, and are not final and unchallengeable.

Operator, governing law and courts

100M is operated from England and Wales by an individual operator trading as 100M and operating 100000000.photos, and is accessible internationally. These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you continue to benefit from mandatory consumer protections provided by the law applicable to you that cannot lawfully be excluded. The courts of England and Wales have jurisdiction, but consumers may also have the right to bring proceedings in the courts where they live. A person acting wholly or mainly for business purposes agrees to the exclusive jurisdiction of the courts of England and Wales.

Complaints and disputes

Complaints are free through the Contact page. We encourage you to contact us first so we can try to resolve the issue. This is not an absolute prerequisite to exercising statutory rights or bringing proceedings. We will try to resolve complaints directly; where applicable, information about available alternative dispute-resolution options may be provided if a dispute remains unresolved. Nothing prevents either party from exercising legal rights or seeking a remedy through an appropriate court or other legally available process. We do not require mandatory arbitration and do not waive consumer court rights.

Translations and interpretation

Translations are provided to make these Terms accessible in supported languages. If a translation creates uncertainty or inconsistency, the English version may be used to help interpret the intended meaning, subject always to mandatory consumer law and rights that cannot lawfully be excluded.
